PA’s LTE Standards Essential IPR report and database, aims to increase transparency in the IPR landscape for LTE.

Many companies own patents that they claim are “Potentially Essential” to wireless standards. Standards Essential Patents (SEPs) are embedded within the standard itself and are infringed by all equipment complying with the standard – they cannot be avoided by clever engineering. Understanding the patent landscape is a complex challenge for those involved in patent licensing and royalty negotiation.

In the absence of transparent patent ownership licensees, policy makers and regulators struggle to set the correct prices for patent acquisitions, patent transfers, licenses and damage awards. The objective of PA's analysis is to bring clarity to the landscape for LTE (3GPP-LTE).

PA's database and report provide the information that the industry needs

Now in its 5th major version, PA’s LTE IPR report provides independent analysis of the patents claimed to be essential to LTE technology. Version E of PA’s LTE IPR database contains over 5000 patent families, from 50 companies including major vendors in US, Europe, China, Korea and Japan.

PA has taken the lists of patents declared to ETSI as potentially technically essential to the LTE (3GPP-LTE) standard and evaluated them against the technical specifications to understand whether they are really Essential or just a useful implementation, or not relevant at all!

The analysis is provided by PA's in-house patent experts. The patent evaluation is captured into a database - part of the deliverable. 

The database contents include for each patent that we have successfully evaluated:

  • Details of the declarations to ETSI (declaration and disclosure information)
  • Details of the patent family (application number, patent number, equivalents)
  • Comments from PA’s engineer who reviewed the patent: including information regarding the technical specification which the patent is related to
  • PA’s conclusion: whether the patent is potentially technically essential to 3GPP-LTE, useful but not technically essential to 3GPP-LTE, or not relevant to 3GPP-LTE

The report summarises our findings drawing conclusions about the 3GPP-LTE patent landscape.

The associated report presents analysis of the LTE SEP landscape, including strengths and weaknesses of the individual companies and their SEP portfolios.
